What is a White Collar crime?
“White Collar” crimes are so-called because they are often seen as taking place in an office setting and are usually financial in nature as opposed to crimes against people like theft and assault crimes. Common types of white collar crimes are embezzlement, crimes involving securities like insider trading, tax evasion and other financial crimes.
White collar crimes are usually felonies and the penalties can be severe. Having a lawyer present froim the very beginning of an investigation is critically important in cases like this.
Interference with an investigation
Sometimes in the course of a white collar criminal investigation, the person who is charged does things that are perceived by the police and prosecution as hindering the investigation, including lying to investigators under oath. Hindering an investigation itself is a crime and can often carry with it a severe penalty separate from the original charges. A few celebrities have gotten prison sentences for “obstruction of justice.”
Don’t fall into this trap. Talk to a lawyer before you say anything to investigators. If you have already talked to them, try not to say anything else until we’ve had a chance to discuss what you’re facing and how we can work together to minimize your likelihood of conviction. Even innocent people can have their words turned around to mean something completely different from what they meant to say.
The constitution guarantees that the State must prove its case against you beyond a reasonable doubt and they will use things you said to try to prove their case. Through my 27+ years of criminal law practice, I understand what it takes to make sure you get your fair trial and to make sure that you aren’t convicted of a crime you did not commit or that the State cannot prove.
